I think the first thing we should do is get everything that has been released by the team (Map, guides, race, stories etc)

i very much agree, we cannot use them without rights

i'm just saying that once we do get the rights, a lot of stuff is already there

Yes, but like has been stated more than once... to use them would be illegal without permission, they remain the intillectual property of MR ... if MR ceases to exist, the become the property of it's financial backing...

even though the game is 'gone' the 3+yrs of work that they put into the game has street value.. probably somewhere in the region of $1,000,000+ .. if we tried to use something they legally own, they could sue for damages to their trademarks and intellectual property.

the map, as well as sketches of characters, can be found in the clientdataui folder of your wish program folder...

Ok this where the whole legal situation comes into it...

If MR doesn't sell the IP rights to the 'wish project', using their ideas - hell even having their logo on the main page, is copyright infringment... actually taking all the content from their site for the purpose of making a game is very much illegal...

Unless MR gave permission for you/us/whatever to go ahead and develop 'wish', we cannot use the world as they developed it, we can't use the creatures, characters, towns, or equiptment... the only way we can 100% duplicate it, is by getting direct permission from them... the closeset that we can come without their permission is to build a game based on the 'idea' behind wish.. that being, a heavily skills oriented PvE MMORPG... beyond that would cause a legal situation.
